DMCA / Copyright Takedown Policy

RoastMyResume (roastmyresume.io), operated by BMCM LLC, respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), we will respond promptly to claims of copyright infringement committed using our service.

Filing a DMCA Takedown Notice

If you believe that content hosted on or generated by RoastMyResume infringes your copyright, please submit a written notice to our designated DMCA agent containing the following information:

  1. Identification of the copyrighted work: A description of the copyrighted work you claim has been infringed, or a representative list if multiple works are involved.
  2. Identification of the infringing material: The URL(s) or other specific location of the material you claim is infringing, with enough detail for us to locate it.
  3. Your contact information: Your full legal name, mailing address, telephone number, and email address.
  4. Good faith statement: A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy and authority statement: A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf.
  6. Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Counter-Notification Process

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our DMCA agent. Your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled and the location where it appeared before it was removed.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district (or if you are outside the United States, the Northern District of Illinois), and that you will accept service of process from the person who provided the original takedown notice or their agent.

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the original complainant does not file a court action within 10 business days, we may restore the removed material.

Repeat Infringer Policy

In accordance with the DMCA, we maintain a policy to terminate, in appropriate circumstances, the accounts or access of users who are repeat infringers. If a user is found to have repeatedly uploaded or generated infringing content, we may permanently restrict their access to the service at our sole discretion.

Good Faith Notice

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake, may be subject to liability for damages, including costs and attorneys' fees.
